Terms of Service

1. Acceptance of Terms
Welcome to Unsaid. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Unsaid LLC ("Unsaid," "Company," "we," "us," or "our") governing your access to and use of the Unsaid platform, including our website, mobile applications, APIs, and all related services (collectively, the "Service").
BY ACCESSING OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT ACCESS OR USE THE SERVICE.
Your use of the Service is also governed by our Privacy Policy, Community Guidelines, and any other policies we may publish from time to time, all of which are incorporated into these Terms by reference.
2. Eligibility
To use the Service, you must:
- Be at least 18 years of age, or the age of legal majority in your jurisdiction, whichever is greater
- Have the legal capacity to enter into a binding contract with Unsaid
- Not be prohibited from using the Service under applicable laws
- Not have been previously suspended, removed, or banned from the Service
- Not be a convicted sex offender
By using the Service, you represent and warrant that you meet all eligibility requirements. We reserve the right to verify your eligibility at any time and to terminate your access if you do not meet these requirements.
3. Account Registration and Responsibilities
3.1 Account Creation
To access certain features of the Service, you must create an account. When creating an account, you agree to provide accurate, current, and complete information and to update such information to keep it accurate, current, and complete.
3.2 Account Security
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Create a strong, unique password and keep it confidential
- Not share your account credentials with any third party
- Immediately notify us of any unauthorized access to or use of your account
- Not use another person's account without permission
- Maintain only one account per person
Unsaid will not be liable for any loss or damage arising from your failure to comply with these security obligations. You acknowledge that you are fully responsible for all activity that occurs under your account, whether or not authorized by you.
4. User Content and License Grant
4.1 Your Content
"User Content" means any content, including but not limited to text, images, videos, audio, graphics, and other materials that you submit, post, upload, or otherwise make available through the Service. You retain ownership of your User Content, subject to the license granted below.
4.2 License Grant to Unsaid
By submitting User Content to the Service, you grant Unsaid a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display such User Content in connection with operating and providing the Service, including for purposes of promoting and redistributing part or all of the Service.
This license includes the right to make your User Content available to other companies, organizations, or individuals for the syndication, broadcast, distribution, or publication of such User Content on other media and services, subject to our terms and conditions for such use.
4.3 Representations and Warranties
You represent and warrant that:
- You own or have the necessary rights to submit the User Content and to grant the license above
- Your User Content does not violate the privacy rights, publicity rights, intellectual property rights, or other rights of any person or entity
- Your User Content does not contain any material that is defamatory, obscene, illegal, threatening, or otherwise objectionable
- Your User Content complies with these Terms and all applicable laws
5. Prohibited Content and Conduct
You agree not to engage in any of the following prohibited activities or post any of the following prohibited content. Violation of these prohibitions may result in immediate termination of your account and, where applicable, reporting to law enforcement authorities.
5.1 Child Sexual Abuse Material (CSAM) - ZERO TOLERANCE
Unsaid maintains an absolute zero-tolerance policy for child sexual abuse material (CSAM). This includes, but is not limited to:
- Any visual depiction of sexually explicit conduct involving a minor (any person under 18 years of age)
- Any content that sexualizes minors, including drawings, animations, or computer-generated images
- Any content that promotes, glorifies, or facilitates child sexual abuse
- Links to external sites containing CSAM
ANY ACCOUNT FOUND TO BE POSTING, SHARING, OR SOLICITING CSAM WILL BE IMMEDIATELY AND PERMANENTLY TERMINATED. ALL CONTENT AND ASSOCIATED ACCOUNT INFORMATION WILL BE PRESERVED AND REPORTED TO THE NATIONAL CENTER FOR MISSING & EXPLOITED CHILDREN (NCMEC) AND APPROPRIATE LAW ENFORCEMENT AUTHORITIES. WE FULLY COOPERATE WITH LAW ENFORCEMENT INVESTIGATIONS.
5.2 Sexual Exploitation of Minors
In addition to CSAM, the following conduct related to minors is strictly prohibited:
- Grooming: Any attempt to build a relationship with a minor for the purpose of sexual exploitation
- Solicitation: Requesting sexual content from minors or requesting to meet minors for sexual purposes
- Sextortion: Threatening to expose sexual images of minors or coercing minors into sexual activity
- Trafficking: Any content that facilitates or promotes the trafficking of minors
- Any sexual communication with or about minors
- Sharing personal information of minors for exploitative purposes
Violations will result in immediate account termination and reporting to NCMEC and law enforcement.
5.3 Non-Consensual Intimate Imagery (NCII)
The following is strictly prohibited:
- Sharing intimate, sexual, or nude images of any person without their explicit consent ("revenge porn")
- Threatening to share intimate images without consent
- Soliciting or offering non-consensual intimate imagery
- Deepfakes or synthetic media depicting individuals in sexual situations without consent
- Creepshots, upskirt photos, or other images taken without the subject's knowledge or consent
Violations will result in immediate content removal, account termination, and may be reported to law enforcement.
5.4 Violence and Threats
- Credible threats of violence against individuals or groups
- Content that incites, glorifies, or promotes violence
- Graphic violence, gore, or mutilation
- Terrorist content or content promoting terrorist organizations
- Instructions for creating weapons or carrying out violent acts
- Content celebrating or trivializing violent tragedies
5.5 Harassment and Hate Speech
- Targeted harassment, bullying, or intimidation of individuals
- Coordinated harassment campaigns
- Doxxing: sharing private information to facilitate harassment
- Hate speech targeting individuals or groups based on race, ethnicity, national origin, religion, sex, gender, gender identity, sexual orientation, disability, or serious disease
- Slurs, dehumanizing language, or symbols associated with hate groups
- Content promoting or glorifying hate groups or ideologies
5.6 Illegal Activities
- Content that promotes, facilitates, or instructs illegal activities
- Sale or solicitation of illegal drugs, controlled substances, or drug paraphernalia
- Sale or solicitation of illegal weapons or explosives
- Fraud, scams, or deceptive schemes
- Money laundering or financial crimes
- Human trafficking or exploitation
- Hacking, phishing, or distribution of malware
5.7 Self-Harm and Suicide
- Content that promotes, glorifies, or provides instructions for self-harm or suicide
- Content that encourages others to engage in self-harm or suicide
- Graphic depictions of self-harm
- Pro-eating disorder content that promotes dangerous behaviors

5.8 Impersonation and Misinformation
- Impersonating another person, brand, or organization in a misleading manner
- Creating fake accounts to deceive others
- Spreading false information that could cause harm to individuals or public safety
- Manipulated media intended to deceive (excluding clearly labeled satire or parody)
- False claims about elections, voting, or civic processes
- Dangerous health misinformation
5.9 Spam and Platform Manipulation
- Automated posting, scraping, or data collection
- Artificially inflating engagement metrics
- Operating multiple accounts for deceptive purposes
- Unsolicited commercial messages or advertising
- Circumventing security measures, rate limits, or access restrictions
5.10 Intellectual Property Violations
- Copyright infringement
- Trademark infringement
- Sharing pirated content
- Counterfeit goods
6. Content Moderation
6.1 Moderation Practices
Unsaid employs a combination of automated systems and human review to moderate content on the platform. We reserve the right to:
- Remove or disable access to any content that violates these Terms, without prior notice
- Use automated detection systems, including hash-matching technology (such as PhotoDNA) to detect known CSAM
- Use machine learning and AI systems to detect potentially violating content
- Employ human moderators to review flagged content and make enforcement decisions
- Proactively scan content for violations before or after posting
- Limit the visibility or reach of content that may violate our policies
6.2 Enforcement Actions
Depending on the severity of the violation, we may take one or more of the following actions:
- Warning: Notification of the violation
- Content removal: Deletion of the violating content
- Feature restrictions: Limiting access to certain features
- Temporary suspension: Temporary loss of account access
- Permanent termination: Permanent ban from the Service
- Legal action: Reporting to law enforcement and/or pursuing civil remedies
6.3 Law Enforcement Cooperation
Unsaid cooperates fully with law enforcement authorities. We will:
- Report all apparent CSAM to NCMEC as required by federal law (18 U.S.C. § 2258A)
- Preserve account information and content when required by law or when we believe there is imminent risk of harm
- Respond to valid legal process, including subpoenas, court orders, and search warrants
- Proactively report credible threats of violence or imminent harm to appropriate authorities
6.4 Appeals Process
If you believe your content was removed or your account was actioned in error, you may submit an appeal within 30 days of the enforcement action. Appeals will be reviewed by a different moderator than the one who made the original decision. We will notify you of the outcome of your appeal. Note that appeals are not available for violations involving CSAM, sexual exploitation of minors, or credible threats of violence.
7. Copyright and DMCA Policy
7.1 DMCA Compliance
Unsaid respects the intellectual property rights of others and expects users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and will respond to notices of alleged copyright infringement that comply with the DMCA and other applicable laws.
7.2 Filing a DMCA Notice
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide our designated copyright agent with the following information:
- A physical or electronic signature of the copyright owner or authorized agent
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing and its location on the Service
- Your contact information (address, telephone number, email)
- A statement that you have a good faith belief that the use is not authorized
- A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner

7.3 Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, Unsaid has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
8. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
UNSAID DOES NOT WARRANT THAT:
- THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
- ANY DEFECTS OR ERRORS WILL BE CORRECTED
- THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
- THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS
- USER CONTENT IS ACCURATE, RELIABLE, OR APPROPRIATE
UNSAID IS NOT RESPONSIBLE FOR ANY USER CONTENT POSTED ON THE SERVICE. YOU UNDERSTAND AND AGREE THAT YOU MAY BE EXPOSED TO USER CONTENT THAT IS INACCURATE, OFFENSIVE, INDECENT, OR OBJECTIONABLE, AND YOU AGREE TO WAIVE ANY LEGAL OR EQUITABLE RIGHTS OR REMEDIES YOU HAVE OR MAY HAVE AGAINST UNSAID WITH RESPECT THERETO.
YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL UNSAID, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
- YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE
- ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, INCLUDING ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT
- ANY USER CONTENT OBTAINED FROM THE SERVICE
- UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT
- ANY OTHER MATTER RELATING TO THE SERVICE
IN NO EVENT SHALL UNSAID'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO UNSAID, IF ANY, IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
THE LIMITATIONS OF THIS SECTION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, AND WHETHER OR NOT UNSAID HAS BEEN INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
10. Indemnification
You agree to defend, indemnify, and hold harmless Unsaid, its affiliates, and their respective directors, officers, employees, agents, suppliers, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from:
- Your use of and access to the Service
- Your violation of these Terms
- Your violation of any third-party right, including any intellectual property, privacy, or publicity right
- Your User Content
- Any claim that your User Content caused damage to a third party
- Your violation of any applicable law or regulation
This indemnification obligation will survive the termination of these Terms and your use of the Service.
11. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
11.1 Agreement to Arbitrate
You and Unsaid agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (collectively, "Disputes") will be resolved exclusively through final and binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
11.2 Arbitration Procedures
The arbitration will be administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The arbitration will be conducted in the English language by a single arbitrator. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
11.3 Class Action Waiver
YOU AND UNSAID AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. UNLESS BOTH YOU AND UNSAID AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
11.4 Jury Trial Waiver
YOU AND UNSAID HEREBY WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY.
11.5 Opt-Out
You may opt out of this arbitration agreement by sending written notice to legal@unsaidwomen.com within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of this arbitration agreement.
11.6 Exceptions
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
12. Governing Law and Jurisdiction
These Terms and any Disputes shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
To the extent that any lawsuit or court proceeding is permitted hereunder, you and Unsaid agree to submit to the exclusive personal jurisdiction of the state and federal courts located in Wilmington, Delaware, for the purpose of litigating any such Dispute.
13. Termination
13.1 Termination by You
You may terminate your account at any time by using the account deletion feature in the app settings or by contacting us at support@unsaidwomen.com.
13.2 Termination by Unsaid
Unsaid reserves the right to suspend or terminate your account and access to the Service at any time, for any reason or no reason, with or without notice, including but not limited to:
- Violation of these Terms or any applicable policies
- Conduct that we believe is harmful to other users, third parties, or Unsaid
- Extended periods of inactivity
- Request by law enforcement or government agencies
- Discontinuation or material modification of the Service
- Unexpected technical or security issues
13.3 Effect of Termination
Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability. We may retain certain information as required by law or for legitimate business purposes.
14. Modifications to Terms
Unsaid reserves the right to modify these Terms at any time. If we make material changes to these Terms, we will notify you by email (if you have provided one), by posting a notice on the Service, or by other means we deem appropriate.
Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the Service and may terminate your account.
We encourage you to review these Terms periodically to stay informed of updates.
15. General Provisions
15.1 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.
15.2 Entire Agreement
These Terms, together with the Privacy Policy and any other policies incorporated by reference, constitute the entire agreement between you and Unsaid regarding the Service and supersede all prior agreements and understandings.
15.3 Waiver
The failure of Unsaid to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Unsaid.
15.4 Assignment
You may not assign or transfer these Terms or your rights hereunder without Unsaid's prior written consent. Unsaid may assign these Terms without restriction. These Terms shall be binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.
15.5 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights in any individual or entity that is not a party to these Terms.
15.6 Force Majeure
Unsaid shall not be liable for any failure or delay in performing its obligations under these Terms due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
